TERMS AND CONDITIONS

1. DEFINITIONS

“Company” refers to Edusworkshop, located at 17 Chelsmford avenue, Belmore, Australia.

“Customer” refers to the person, firm, or company purchasing goods from the Company.

“Goods” refers to the furniture items and related products supplied by the Company.

2. ACCEPTANCE

2.1 These Terms and Conditions apply to all orders placed with the Company and constitute the entire agreement between the Customer and the Company.

2.2 By placing an order with the Company, the Customer is deemed to have accepted these Terms and Conditions.

3. QUOTATIONS AND PRICING

3.1 Quotations are valid for 30 days from the date of issue unless otherwise specified.

3.2 All prices are in Australian Dollars (AUD).

3.3 Prices are subject to change without notice prior to acceptance of an order.

4. PAYMENT TERMS

4.1 For custom orders, a non-refundable deposit of 50% of the total price is required to commence work.

4.2 The balance payment is due prior to delivery or collection of goods.

4.3 For stock items, full payment is required at the time of purchase.

4.4 Payment methods accepted include bank transfer, credit card, and PayPal.

5. CUSTOM ORDERS

5.1 Custom orders cannot be cancelled once production has commenced.

5.2 Minor variations in timber grain, color, and texture are natural characteristics of wooden furniture and are not considered defects.

5.3 The Company reserves the right to make minor modifications to designs where necessary without affecting the overall aesthetic or functionality.

6. DELIVERY

6.1 Delivery timeframes are estimates only and may vary depending on production schedules.

6.2 Delivery charges are not included in the product price unless specifically stated.

6.3 Risk in the goods passes to the Customer upon delivery.

6.4 The Customer must inspect goods upon delivery and notify the Company of any damage or defects within 48 hours.

7. TITLE AND OWNERSHIP

7.1 Ownership of goods remains with the Company until full payment has been received.

7.2 Until ownership passes to the Customer, the Customer holds the goods as bailee for the Company.

8. WARRANTIES

8.1 All furniture items come with a 2-year structural warranty from the date of delivery.

8.2 The warranty covers manufacturing defects but does not cover damage resulting from misuse, normal wear and tear, or improper care.

8.3 Natural movement, minor checking, or seasonal movement in solid timber is normal and not covered by warranty.

8.4 This warranty is in addition to rights provided by Australian Consumer Law.

9. RETURNS AND REFUNDS

9.1 Custom-made furniture cannot be returned unless deemed faulty.

9.2 For stock items, returns may be accepted within 14 days if the item is in original condition and packaging.

9.3 A restocking fee of 15% may apply to returns not due to product fault.

10. INTELLECTUAL PROPERTY

10.1 All designs, drawings, and specifications remain the intellectual property of the Company.

10.2 The Customer agrees not to reproduce or share designs without written permission.

11. LIABILITY

11.1 The Company’s liability is limited to the purchase price of the goods.

11.2 The Company is not liable for any consequential loss or damage arising from the use of the goods.

11.3 To the fullest extent permitted by law, all terms, conditions, and warranties implied by law are excluded.

12. PRIVACY

12.1 The Company collects and stores customer information in accordance with the Privacy Act 1988 (Cth).

12.2 Customer information will only be used for purposes related to the business transaction and will not be shared with third parties except as required by law.

13. FORCE MAJEURE

13.1 The Company shall not be liable for any delay or failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, or supply chain disruptions.

14. GOVERNING LAW

14.1 These Terms and Conditions are governed by the laws of New South Wales, Australia.

14.2 Any disputes arising shall be subject to the exclusive jurisdiction of the courts of New South Wales.

15. CHANGES TO TERMS

15.1 The Company reserves the right to modify these Terms and Conditions at any time.

15.2 Current Terms and Conditions will be provided upon request.
